2. Privacy policy
General information and legal basis
The aim of data protection is to protect the personality and fundamental rights of individuals whose personal data is processed. Contrary to what one might think, it is not the data itself that is protected, but the personalities of the individuals whose data is being processed. That said, the processing of personal data is, quite rightly, governed by strict rules and principles.
At constitutional level, art. 13 para. 2 of the Swiss Federal Constitution (Cst.; RS 101) guarantees individuals protection against the misuse of their personal data. The Federal Data Protection Act (DPA; 235.1) applies to the processing of personal data by private individuals and federal bodies. At cantonal level, the Convention intercantonale relative à la protection des données et à la transparence dans les cantons du Jura et de Neuchâtel (CPDT-JUNE; RSN 150.30) applies to the processing of personal data by cantonal authorities, as defined by law, including Greub Machines SA.
The law on archiving (LArch; RSN 442.20) and its implementing regulations constitute the basic legislation on archiving; they prescribe the way in which archiving must be carried out. In particular, they set out the most important definitions, the responsibilities of each party and the main stages in the archiving process.
